What is a Chapter 13?
A Chapter 13 in a nut shell is a reorganization of your debts. There are different classes of debt. Secured debt (house loans, car loans), priority debt (taxes, alimony) unsecured debt (credit cards, medical bills) are reorganized in a Chapter 13 plan.
Basically, you will make a monthly payment each month to the Bankruptcy Chapter 13 trustee (Chapter 13 Trustee @ Flint) that Trustee will disperse that payment according to the submitted plan. Why would you file a Chapter 13 instead of a Chapter 7?
If you are behind on your house you can file a Chapter 13 and reorganize your mortgage. You can spread your arrears out. This is under Federal Law. The mortgage company has no choice in the matter. As long as your Chapter 13 plan is within the law.
If you have already received a Chapter 7 Discharge within 8 years you can file a Chapter 13 after 4 years.
Protecting non-exempt assets.
Protecting co-signers.
If you don't pass the means test because you make to much money then you can file a Chapter 13 and pay back a portion of your unsecured debt. Some people may also file a Chapter 13 because they want to pay back a portion of their unsecured debt for purely moral reasons.
