What should you do?

If you have a collection agency harassing you. Don't avoid them. Keep records of all phone conversations. Write down time, who you talked to, what was said, dated it, and make notes. Here are a few things to look for:

Every letter must say they are a debt collection agency and any information will be used for that purpose.

Within 5 days of a collection agency's first communication with you they must tell you you have 30 days to dispute the debt. (This is called the validation period.)

They cannot talk to anyone about your debt except your spouse.

They cannot make false or misleading statements.

They cannot harass or humiliate you.

They cannot threaten you.

They cannot prematurely cash a post dated check.

Calling after 9:00 PM is forbidden.

For each violation of the Fair Debt Collection Act you may be entitled to $1,000.00 plus all attorney fees and costs. That is why keeping good records are important.

Under Michigan Law you can sue anyone who unfairly attempts to collect debt. It doesn't have to be a debt collection agency.
