			<content:encoded><![CDATA[<p>This is the time of the year when tax issues and bankruptcy become an issue. The first most comoon question is can I keep my tax return if I file for Bankruptcy. And of course like anything in the law the answer is yes and no. If you file for chapter 7 if you have unused wild card exemptions then you can. The wild card is around $11,000. So if your tax return is under that amount in a chpater 7 then, yes, you keep. If you file a chapter 13; however, you have to submit your tax return to the plan. After your plan is confirmed so you wouldn&#8217;t have to submit this years but next year. That is only in a Chapter 13 reorganization.</p>
<p>The next tax issue involves 1099 debt forgiveness. If you file a bankruptcy discharging your debt the creditor will send you a 1099. You do not have to pay tax on this if you declared bankruptcy.</p>
<p>Another tax issue in bankruptcy involves garnishments of State tax returns.  Once a creditor gets a judgment and files for a tax garnishment that garnishment perfects at filing of. So inorder to stop it you must file for bankruptcy within 90 days of the perfection.  In other words if they perfected it in July and you file bankrutpcy in Febuary and have not filed your 2011 tax reurns yet you still will not get them because you already lost them. The only creditor that can garnish Federal Tax returns is the IRS and student loan people. </p>
<p>If you are expecting a tax return and are thinking about bankruptcy now is a good time to call me for a fee counseltation. I am still offering lower fees. I will propbably be doing the $600 Bankruptcy for the month of Febuary then I will be raising my fee. </p>

			<content:encoded><![CDATA[<p>Recent studies show that stress is linked to all sorts of problems from over eating to lost of sleep. One of the most stressful problems in society today is financial stress. Financial stress can cause divorce, loss of sleep, emotional pain, and depression. With all the job lay-offs in Flint Michigan and other auto industry cities in Michigan it has had its impact on all business in Michigan. The lack of funds can have a devastating emotional impact and cause depression.</p>
<p>Add aggressive debt collector to mix. You know the one&#8217;s. The guys that call everyday like you forgot they called you two hours ago. The ones that never herd of the Fair Debt Collection Practices Act. The guys that invoke more stress into your life. Yeah, those guys. The guys you want to just kick in the teeth. Sometimes you might even have the nmoney to pay them but just because they called and made you feel like crap you are not going to pay them.</p>

			<content:encoded><![CDATA[<p>With the new year coming up people  are tired of strugling.  A lot of people  want to know how a Chapter 13 Bankruptcy can turn their life around.  One of the biggest problems people in Michigan struggle with is the decreasing value of the real estate market. The top two reasons to consider filing for a Chapter 13 reoranazation in Michigan is to lein strip a home equity loan or second mortgage. If at the time you took out the home equity loan you had equity in your home and because of the drop in real estate value you are upside down on your home you can file for chapter 13 and file what is called an adversary case and get a Federal Court Order that wipes out the home equity loan.</p>
<p>The Second reason you would want to consider filing for chapter 13 in Michigan is if you are behind on your payments on the first you can stop a foreclosure and spread the arrears out over a number of years.  There are times when the mortgage company is just unreasonable and you need help.</p>
<p>Other things that can be done that gives you help in bankruptcy relief under Chapter 13 in Michigan is IRS debt can be paid and sometimes reduced, back child support, property tax, and you can sometimes do a car loan modification.</p>

			<content:encoded><![CDATA[<p>In a recent Michigan case, <em>in re: Pixley, </em>Eastern District of Michigan case no 10-6665, Judge Thomas Tucker made a ruling that if you have a default judgment against you and if the complaint and the judgment alleged fraud you can not discharge this debt.</p>
<p>This is a scary decision. Often time collection attorneys likeVarchetti, &amp; Oliver  Roosen, out of Mt. Clemens Michigan will put claims of fraud in ever credit card collection case they file. I don&#8217;t understand how this law firm gets away with this cut and paste form of complaint. Why the judges in State Courts allow this law firm to clearly make frivolous claims in their collection complaints is beyond me. But I have a collection of complains by this firm of general collection credit card complaints and they all alleged fraud. Now according to Judge Tucker in the <em>Pixley</em> decision, Richard Roosen can put his fraud claim in a credit card collection complant ( without any due diligence as to if its true) and a unsafisicated  person ignores the complaint because they are saving money for a bankruptcy and it goes to default and suddenly they have a non dischargeable debt. There may not have been any fraud at all. It may have been a divorce or a job loss, but collection attorney throws a fraud claim in a general credit card collection case and you get stuck with the debt. This creates all sorts of problems.</p>
<p>Prior to this decision when you filed bankruptcy it wiped out most state court cases. If a creditor wanted to make a fraud claim they had to file an adversary case in Bankruptcy Court. And for the most part this is still true. But now if you have a default judgment and it makes a fraud claim you can not discharged  it. So if you are being sued by a credit card company you better read that complaint. If it alleges fraud you better file an answer within the 21 days.</p>
<p>Call my office today if you have questions about law suits. Particualy if you have a law firm like Roosen, Varchetti, &amp; Oliver making false claims of fraud against you.  Do not neglect a law suit. It can effect you for a long time.</p>

			<content:encoded><![CDATA[<p>Secured debt, like a car loan, house, or boat, usually requires a reaffirmation agreement to be signed with the creditor that you agree not to discharge the loan in order to keep the car or boat.  You are not required to reaffirm secured debt. You can surrender the collateral and walk away. If you do reaffirm it you have up to 60 days to change your mind.</p>
<p>In order to reaffirm debt you must be current on the loan and carry insurance.  There is a form in the bankruptcy paperwork called a statement of intent. This document informs the creditor your intention. If want to surrender the collateral the creditor can file a motion for lift of automatic stay so that they can repose the property. In order to reaffirm debt your expenses must be less then your income. If your expenses are greater than your income you have to go before a judge and explain why you believe you can pay for the loan.</p>
<p>A lot of people are concerned about the reaffirmation and how it gets handled. This is covered in the fee so you don&#8217;t have to do anything but sign it. Usually the creditor emails my office the reaffirmation and I contact you.</p>
<p>Usually reaffirmation agreements are a simple process, unless your creditor is Ford Motor Credit. Ford Motor credit seems to make the process of reaffirmation agreements more difficult then they need to be.</p>
